  Klauzula informacyjna dla kontrahentów

 Fabryka Obrabiarek RAFAMET S.A. dba o ochronę danych osobowych swoich Kontrahentów i informuje, że:

 1)      Podanie danych jest wymogiem zawarcia umowy na usługi realizowane przez Fabrykę Obrabiarek RAFAMET S.A., a bez ich podania nie jest możliwe skorzystanie z naszych usług, a tym samym właściwa obsługa Kontrahenta;

 2)      Administratorem podanych danych osobowych Kontrahenta jest Fabryka Obrabiarek RAFAMET S.A. z siedzibą w Kuźni Raciborskiej (47-420),
przy ul. Staszica 1;

 3)      Będziemy przetwarzać dane osobowe Kontrahenta, aby:

• zawrzeć umowę i wypełniać jej warunki,
• wykonywać rozliczenia finansowe,
• prowadzić działania marketingowe,
• sprzedawać nasze produkty i usługi;

 4)      Podstawą prawną przetwarzania danych Kontrahenta będzie odpowiednio:

• niezbędność do wykonania umowy zawartej z Kontrahentem,
• niezbędność do wypełnienia obowiązku prawnego ciążącego na Administratorze – art.106e ust. 1 ustawy o podatku od towarów i usług,
• prawnie uzasadniony interes – w odniesieniu do przetwarzania danych dla celów marketingowych w trakcie trwania stosunku prawnego między Kontrahentem a Fabryką Obrabiarek RAFAMET S.A.;

 5)      W niektórych sytuacjach mamy prawo przekazać dane Kontrahenta – jeśli będzie to konieczne, abyśmy mogli wykonywać nasze usługi:

• osobom upoważnionym przez nas – naszym pracownikom
  i współpracownikom, którzy muszą mieć dostęp do danych, aby wykonywać swoje obowiązki,
• podmiotom przetwarzającym, którym zlecamy czynności przetwarzania danych (np. kancelaria radcy prawnego);

 6)      Dane Kontrahenta będziemy przetwarzać przez okres wymagany przepisami prawa podatkowego – do 6 lat;

 7)      Kontrahent posiada prawo do:

• wglądu do swoich danych,
• aktualizacji swoich danych,
• przenoszenia danych,
• ograniczenia przetwarzania,
• wniesienia skargi do Prezesa UODO, jeśli uzna, że przetwarzanie jego danych osobowych nie jest zgodne z przepisami o ochronie danych osobowych,
• sprzeciwu wobec przetwarzania jego danych w celach marketingowych.

 Privacy Notice for Business Partners

 Fabryka Obrabiarek RAFAMET S.A. is committed to protecting the personal data of its Business Partners and hereby provides the following information:

 1)      Providing personal data is a requirement for entering into a contract for services provided by Fabryka Obrabiarek RAFAMET S.A. Without providing such data, it is not possible to use our services and, consequently, to ensure proper service to the Business Partner;

 2)      The controller of the Business Partner’s personal data provided is Fabryka Obrabiarek RAFAMET S.A., with its registered office at ul. Staszica 1, 47-420 Kuźnia Raciborska;

 3)      We will process the Business Partner’s personal data for the following purposes:

·         entering into a contract and performing its terms,
·         carrying out financial settlements,
·         conducting marketing activities,
·         selling our products and services;

 4)      The legal bases for processing the Business Partner’s data will be,
as applicable:

·         necessity for the performance of a contract concluded with the Business Partner,
·         necessity for compliance with a legal obligation to which the Controller
is subject – Article 106e (1) of the Value Added Tax Act,
·         legitimate interest – with regard to the processing of data for marketing purposes during the existence of the legal relationship between the Business Partner and Fabryka Obrabiarek RAFAMET S.A.;

5)      In certain circumstances, we may disclose the Business Partner’s data if this is necessary for us to provide our services:

·         to persons authorised by us – our employees and associates who need access to the data in order to perform their duties,
·         to data processors to whom we entrust data processing activities (e.g. a legal adviser’s law firm);

6)      We will process the Business Partner’s data for the period required under tax law – up to 6 years;

7)      The Business Partner has the right to:

·         access their personal data,
·         have their personal data updated,

·         data portability,
·         restriction of processing,
·         lodge a complaint with the President of the Personal Data Protection Office (UODO) if they consider that the processing of their personal data does not comply with data protection legislation,
·         object to the processing of their data for marketing purposes.
