General Data Protection Regulation (GDPR)

Dear Customer,
from 25th of May 2018, a Regulation from the European Parliament and EU Council on protection of physical persons in relation to personal data processing and in the matter of free flow of such data is in force, hereinafter referred to as GDPR.
Therefore, we want to inform you on the rules of personal data processing by the Machine Tool Factory RAFAMET S.A. and on rights you are entitled to in connection with the Regulation. It is our imperative that you possess complete knowledge and comfort whilst cooperating with RAFAMET S.A.
At the same time we guarantee that your personal data is safe with us and that you can withdraw the consent for collecting and processing of the data at any time, according to the below “Clause on personal data protection.”

CLAUSE ON PERSONAL DATA PROTECTION

Machine Tool Factory RAFAMET S.A., ul. Staszica 1, 47-420 Kuźnia Raciborska NIP 639-000-15-64, REGON 271577318, District Court in Gliwice, X Department of Economics National Court Register, NCR no. 0000069588 (hereinafter referred to as RAFAMET S.A.), as an administrator of personal data collects your personal data, data of your employees and associates.
Personal data referred to, in particular:  
• Name (names) and surnames, contact address,
• Company of the represented subject, telephone number, e-mail address, position,
• In the case of contractors we additionally process the following: Tax Identification Number, REGON, seat address, account number,
 
We collect your personal data for the following purposes:
• Execution of contract in which you are a party, or taking action on your request before the contract is signed (GDPR, art. 6 item 1 point b),
• Marketing of products and services rendered by the Administrator, as necessary for purposes resulting from legally justified businesses realized by the Administrator (GDPR, art. 6, item 1 point f),
• Execution of RAFAMET S.A. duties provided for by law, particularly for issuing and recording of invoices and accounting documents, and for archiving purposes (Art. 112 item 1 of Act on VAT, art. 70 of Tax Ordinance, Act on national archival resource and archives),
• Protection of RAFAMET S.A. rights according to the law, particularly in investigation of overdue payments within debt collection processes and lawsuits.
 
Your personal data will be processed for a period of time:
• In the case of documented sales, the storage period will be indicated in the Act on VAT, Tax Ordinance, Act on national archival resource and archives
• Personal data processed for the purposes of execution of economic activity will be stored for 5 years from the moment in which all economic operations and other connected activities will be finally completed


RAFAMET S.A can transfer your personal data to be processed in relation to the following purposes:
1. Subjects cooperating with RAFAMET S.A. under accounting services, IT, analyses, marketing activities, quality policies, personal data protection policies, debt collection companies with which RAFAMET S.A. has signed an agreement on personal data processing, exclusively for the purposes of the execution of the binding agreement, realization of duties provided for by law, protection of RAFAMET S.A. rights according to the law and realization of justified RAFAMET S.A. business in the sense of rules on personal data protection.
Particularly, RAFAMET S.A. can transfer your personal data to subjects such as: subjects rendering accounting services, IT services, courier and mail services, debt collection companies, auditors, etc. Such subjects are obligated under agreements signed with RAFAMET S.A. to utilize proper safety, technical and organizational measures to protect you personal data and process the data according to GDPR and in this purpose.
2. Supervisory bodies, authorities and other third parties: in the event the personal data is necessary to achieve aforementioned goals and fulfil duties imposed by law. Personal data can be transferred to supervisory bodies, courts and other authorities (e.g. tax authorities and law enforcement agencies), independent external advisers (e.g. auditors) or subject providing benefits.
 
RAFAMET S.A is committed to utilize proper safety measures, both technical and organizational, to protect you personal data. Personal data will be stored by RAFAMET S.A. and/or processing data only during the period it is necessary to achieve goals for which the personal data is stored, performing duties resulting from the law, for the maximum period it is necessary to secure materials for legal proceedings (including tax proceedings) and until possible expiration of claims from the State and RAFAMET S.A.
You are entitled to rights in terms of personal data protection. According to applicable law on data protection, you are authorized to lodge a complaint to the appropriate supervisory board (namely the President of the Office for Personal Data Protection or to the successor body).
Furthermore, as persons concerned by the data, you have the right to:
1. Demand access to you personal data. Person concerned by the data is authorized to receive from RAFAMET S.A. a confirmation of whether his/her personal data is being processed, and if it is being processed, the person is authorized to gain access to the data. RAFAMET S.A. will provide on demand a list of you personal data subject to processing. For all subsequent lists you demand from RAFAMET, the company can charge a fee in reasonable amount resulting from administrative costs.
2. Rectification of personal data. You have the right to rectify your personal data that is incorrect. With the purposes of processing taken into account, you have the right to demand to supplement the incomplete personal data, including by submitting an additional statement.
3. Removal of personal data („the right to be forgotten”). You have the right to demand, unless the law requires no other action, immediate deletion of you personal data and RAFAMET S.A. is obligated to comply without undue delay.
4. Limitations on processing of your personal data. RAFAMET S.A can, on your demand, impose limitation on processing of your personal data to only be used for the purposes you have indicated, unless the law states otherwise.
5. Transfer of personal data. Under certain conditions, you have the right to receive your personal data processed by RAFAMET S.A. in a structured, commonly used format, viable for electronic reading. Moreover, you have the right to transfer the personal data to a different subject.
6. Objection. Under certain conditions, you have the right to lodge an objection – for reasons related to your particular situation – against processing of your personal data and RAFAMET S.A may be obligated to cease processing of the personal data.
